LIMITED WARRANTY COVERAGE
Ascent-Technologies warrants its products to be free of defects in material and/or workmanship, Additionally, the warranty protections issued by Ascent-Technologies are only valid under normal usage conditions, and installed in accordance with the provided installation instruction sheet, specifications, accepted trade practices and local/National Electrical Code. Only when purchased through AUTHORIZED distributors.
The warranties coverage as follows:
Commercial, Brass, Copper, and Stainless Steel Fixtures:
Five (5) year warranty.
LED Integrated Fixtures:
Five (5) year warranty.
LED Driver and (DOB) Fixtures:
Two (2) year warranty.
Aluminum Fixtures (Architectural Grade):
One (1) year warranty.
Transformers:
Ten (10) years warranty on transformer coils.
One (1) year warranty on timers, photocells, and accessories.
Five (5) year warranty on stainless steel enclosures.
LED Lamps:
One (1) year warranty.
All warranties are valid from date of Ascent-Technologies invoice.
THIS WARRANTY EXCLUDES:
Products not used in accordance with directions specified in the installations instruction sheets, local ordinances and National Electrical Code.
Products used with LED lamps not manufactured/supplied by Ascent-Technologies.
Products with unauthorized repair. Damages caused by accident, alteration, misuses and factory repair exceeding the cost of the product.
Products not purchased through authorized distributors.
LIMIT of LIABILITY and OTHER CONDITIONS
Ascent-Technologies reserves the right to issue credit, repair, or replace the defective product, at our option upon receipt of written notification by original customer of the alleged defect only.
Ascent-Technologies assumes no responsibility for improper installation of the product and shall not be liable for any incidental or consequential damages resulting from use of this product.
The use of other companies’ products or components in conjunction with Ascent-Technologies products can be hazardous. Such usage will void and nullify any product warranty issued by Ascent-Technologies.
No other warranties or guarantees; either expressed or implied, exist beyond the stated warranties herein. No employee or agent of Ascent-Technologies may extend, modify and/or change the terms of these warranties.
Ascent-Technologies is not responsible for costs incurred by shipment, replacement, repair, and installation of product by customer or other.
Ascent-Technologies reserves the right to make changes to its products without prior notice.
Limitation on Duration of Implied Warranties
Note: Some states/provinces do not allow limitations on how long an implied warranty lasts, so the below limitation may not apply to you. TO THE EXTENT PERMITTED BY LAW, ANY IMPLIED WARRANTY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND OF FITNESS FOR A PARTICULAR PURPOSE, IS LIMITED TO THE STATUTORY PERIOD OR THE DURATION OF THIS WARRANTY, WHICHEVER IS SHORTER.
Limitation of Special, Incidental or Consequential Damages
Note: Some states/provinces do not allow the exclusion or limitation of special, incidental or consequential damages, so the below limitations and exclusions may not apply to you. Notice to residents of the State of New Jersey: The provisions of this warranty, including its limitations, are intended to apply to the fullest extent permitted by the laws of the State of New Jersey. ASCENT-TECHNOLOGIES SHALL NOT BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING LABOR CHARGES TO REPAIR, REPLACE, INSTALL OR REMOVE THIS PRODUCT), WHETHER ARISING OUT OF BREACH OF ANY EXPRESS OR IMPLIED WARRANTY, BREACH OF CONTRACT, TORT, OR OTHERWISE.
CATEGORY WARRANTY
Explicit Operating Conditions: All products must be installed according to Ascent-Technologies Installation Instructions and supplied lamps must be operated in recommended conditions. This warranty is issued to the original purchaser and is nontransferable. Should any product fail to meet the warranty specified above, Ascent-Technologies, at its option, shall correct any defect by repair or replacement and material only. This warranty is conditioned upon proper storage, installation, use and maintenance. Remedy is expressly limited to repair or replacement only. This warranty is not applicable to any product subjected to abnormal stresses and operating conditions. Ascent-Technologies reserves the right to examine all products prior to the determination of warranty status. All products must be retained for warranty claims. The warranty period starts on the date of original purchase. NO IMPLIED STATUTORY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE SHALL APPLY BEYOND THE AFOREMENTIONED WARRANTY PERIOD. The foregoing warranty is exclusive of all other statutory, written or oral warranties, and no other warranties of any kind, statutory or otherwise, are given or herein expressed. The warranty sets forth Ascent-Technologies’ responsibilities regarding the products and claimant’s exclusive remedy. LIMITATION OF LIABILITY. Ascent-Technologies will not under any circumstances, whether as a result of breach of contract, breach of warranty, tort, strict liability or otherwise, be liable for consequential, incidental, special or exemplary damages including, but not limited to, loss of profits or revenues, loss of use of product or any other goods or associated equipment or damage to any associated equipment, cost of capital, cost of substitute products, facilities of service, down time cost, or claims of claimant’s customers. Ascent-Technologies’ liability on any claim of any kind for any loss or damages arising out of, resulting from or concerning any aspect of this agreement from the products or services furnished hereunder shall not exceed the price of the specific product or lamps which gives rise to the claim. Some states do not allow the exclusion or limitation of damages or the length of time for an implied warranty. Therefore, the limitations or exclusions of consequential or incidental damages
and implied warranties may not apply to certain claimants. This warranty gives the claimant specific legal rights. The claimant may also have other rights, which vary from state to state.
